You must be at least 18 years old and legally capable of entering into a binding contract to place an order through the Website.

Although many of our products are intended for children, orders must be placed by an adult.

These Terms are intended primarily for individual consumers purchasing products for personal use.

If you are purchasing products wholly or mainly for business, trade, resale or professional purposes, you must contact us before placing an order. Separate business-to-business terms may apply.

Our business or Website.

Our products or services.

Our payment or delivery arrangements.

You may be permitted or required to create an account to use certain features of the Website.

You agree to:

Provide accurate, current and complete information.

Keep your account information updated.

Keep your password and login details secure.

Not share your account with another person.

The account is being used fraudulently.

The user has breached these Terms.

The account presents a security risk.

Information supplied by the user is false or misleading.

The Website or another customer may be harmed.

7. PRODUCT INFORMATION

We take reasonable care to ensure that product descriptions, photographs, prices, dimensions, specifications and availability information are accurate.

However:

8. TOY SAFETY, AGE GUIDANCE AND SUPERVISION

You must read and follow all safety information, age recommendations, assembly instructions and warnings supplied with a product.

Age recommendations are based on factors such as the product’s design, complexity, intended use and the presence of small parts.

Products marked as unsuitable for children under a particular age must not be given to children below that age.

Where a product requires adult supervision, it must only be used under appropriate adult supervision.

The purchaser is responsible for:

Selecting products that are suitable for the intended child’s age and abilities.

Checking all warnings and product information before use.

Safety instructions do not replace appropriate adult judgement and supervision.

Nothing in these Terms excludes or limits our legal responsibilities concerning product safety.

9. PRODUCT RECALLS AND SAFETY NOTICES

If we become aware of similar hazards away from children where applicable.

Safety instructions do not replace appropriate adult judgement a safety concern, product recall or corrective action affecting a product you purchased, we may contact you using the details supplied with your order.

You must follow any safety instructions or recall notices provided by us, the manufacturer, a distributor or a relevant authority.

Where instructed, you should stop using the affected product immediately and keep it away from children.

Depending on the circumstances, we may arrange a repair, replacement, refund, return or disposal of the affected product.

Your statutory rights are not affected by this section.

10. PRODUCT AVAILABILITY

All products are subject to availability.

Adding a product to your basket does not reserve it.

We may place limits on the number of products that may be purchased by one customer, household, account, payment method or delivery address.

If a product becomes unavailable after you place an order, we will contact you and refund any amount paid for that product.

We are not obliged to supply an alternative product, although we may offer one for your consideration.

11. HOW TO PLACE AN ORDER

To place an order, you must follow the checkout process and provide the information requested.

Before submitting your order, you will have an opportunity to review and correct your order details.

You are responsible for checking that:

The products and quantities are correct.

The delivery address is complete and accurate.

Your email address and telephone number are correct.

Any personalisation details are accurate.

The selected delivery method is suitable.

Any promotional code has been applied correctly.

By placing an order, you are making an offer to purchase the products in your basket.

12. ORDER ACKNOWLEDGEMENT AND ACCEPTANCE

After you place an order, we will normally send an order acknowledgement by email.

An order acknowledgement confirms that we have received your order. It does not necessarily mean that we have accepted it.

A contract between you and Fun House Toys LTD will normally be formed when we send you a dispatch confirmation or otherwise expressly confirm that your order has been accepted.

We may refuse or cancel an order before acceptance where:

A product is unavailable.

Payment cannot be authorised.

We identify an error in the price or product description.

We suspect fraud or unauthorised payment activity.

The order breaches a purchase restriction.

We are unable to deliver to the address supplied.

The order appears to have been placed for unauthorised resale.

You have breached these Terms.

We are unable lawfully to fulfil the order.

If we cancel an order after taking payment, we will refund the affected amount.

13. PRICES

Product prices will be displayed on the Website.

Unless stated otherwise, prices include VAT at the applicable rate where VAT is chargeable.

Delivery charges and any other unavoidable charges will be shown before you submit your order.

We may change prices at any time, but a change will not normally affect an order we have already accepted.

Promotional prices are available only during the stated promotional period and while stock lasts.

14. PRICING AND WEBSITE ERRORS

We take reasonable care when entering product information and prices, but errors may occasionally occur.

If we discover an obvious pricing or product information error before accepting your order, we may:

Contact you and ask whether you wish to proceed using the correct information.

Reject or cancel the affected part of the order.

Refund any payment already taken for the affected product.

We are not required to supply a product at an obviously incorrect price where the error could reasonably have been recognised as a mistake.

We may correct errors, inaccuracies or omissions on the Website without prior notice.

15. PAYMENT

The payment methods we accept will be displayed during checkout.

Payment methods may include:

Debit or credit card.

PayPal.

Digital wallets.

The payment methods available may change.

You confirm that:

You are authorised to use the selected payment method.

The payment and billing information supplied is accurate.

Sufficient funds or credit are available.

The payment is not connected with unlawful or fraudulent activity.

Payments may be processed by third-party payment providers. Their own terms and privacy policies may also apply.

We may carry out fraud prevention and payment verification checks before accepting or dispatching an order.

16. PROMOTIONAL CODES AND SPECIAL OFFERS

Promotional codes and offers:

Are subject to availability.

May have an expiry date.

May be limited to certain products or customers.

May require a minimum spend.

May be limited to one use per customer, household, account or order.

May not be used with another promotion unless stated otherwise.

Have no cash value.

Must be entered correctly before the order is submitted.

Promotional discounts cannot normally be applied retrospectively.

We may cancel or refuse a promotional code where we reasonably believe it has been copied, transferred, obtained, published or used contrary to the promotional terms.

We may withdraw or amend a promotion before an order is accepted. This does not affect orders already accepted under that promotion.

17. MULTIBUY AND FREE-GIFT PROMOTIONS

Where an order contains products supplied as part of a multibuy, bundle, free-gift or buy-one-get-one-free promotion, the products may be treated as a promotional group.

If you return only part of the promotional group, we may recalculate the price of the products you keep based on the promotion’s terms.

Any refund will reflect:

The amount you actually paid.

The products returned.

The value of any discount or free product connected with the returned item.

Where a free gift was supplied because the order met a qualifying condition, the gift must normally be returned if the qualifying purchase is returned. If the gift is not returned, we may deduct its reasonable value from the refund where legally permitted.

This section does not affect your rights concerning faulty or misdescribed goods.

18. GIFT CARDS

This section applies only if we sell gift cards.

Gift cards:

May be used only through the channels stated when issued.

Cannot normally be exchanged for cash.

Cannot be used to purchase another gift card unless stated otherwise.

Must be kept secure by the recipient.

May be subject to an expiry date displayed when purchased.

May be subject to separate gift-card terms.

We are not responsible for a gift card that is lost, stolen, deleted or used without permission after it has been delivered, unless the loss resulted from something for which we are legally responsible.

Your statutory rights remain unaffected.

19. PRE-ORDERS

This section applies where a product is offered for pre-order.

Any estimated release or dispatch date is an estimate only and may be changed by the manufacturer, supplier or distributor.

We will try to notify you of a significant delay.

Where a pre-order is substantially delayed, discontinued or unavailable, we may cancel it and issue a refund.

Any right to cancel a pre-order before dispatch will be explained on the product page or during checkout.

Your statutory cancellation rights after delivery remain unaffected.

20. DELIVERY

We will deliver products to the address supplied during checkout.

Available delivery services, estimated delivery periods and charges will be displayed on the Website or during checkout.

Delivery dates are estimates unless we expressly agree a guaranteed date.

Delivery may be affected by circumstances outside our reasonable control, including:

Courier or postal disruption.

Severe weather.

Transport disruption.

Customs delays.

Strikes or industrial action.

Supplier delays.

Public emergencies.

Incorrect or incomplete delivery information.

We will take reasonable steps to minimise any delay and keep you informed where appropriate.

If we cannot deliver within the agreed time or, where no time was agreed, within the period required by law, you may have a right to cancel.

21. DELIVERY ADDRESS

You must provide a complete and accurate delivery address.

We are not responsible for a failed or delayed delivery caused by incorrect or incomplete information supplied by you.

If a parcel is returned to us because:

The address was incorrect.

Delivery was refused.

The parcel was not collected.

The courier could not gain access.

The recipient was unavailable after the required delivery attempts.

We may ask you to pay a reasonable additional delivery charge before sending it again.

Any deduction or additional charge will be applied only where legally permitted and where the delivery failure was not caused by us or our delivery provider.

22. RISK AND OWNERSHIP

Products remain at our risk until they come into the physical possession of:

You.

A person identified by you to receive them.

A carrier arranged independently by you and not offered by us.

Ownership of the products passes to you once we have received payment in full and the products have been delivered, unless applicable law provides otherwise.

23. LOST OR DAMAGED DELIVERIES

You should inspect your order after delivery.

Please contact us promptly if:

The parcel appears damaged.

An item is missing.

You receive the wrong product.

A product arrives damaged.

Tracking states that the parcel was delivered but you have not received it.

We may ask you to provide photographs, packaging information or other reasonable evidence to help us investigate.

You must not make a false claim concerning loss, damage or non-delivery.

Nothing in this section transfers to you any delivery risk that legally remains with us.

24. CLICK AND COLLECT

This section applies only if click and collect is offered.

We will notify you when your order is ready for collection.

You may be required to provide:

Your order number.

Collection confirmation.

Proof of identity.

The payment card used for the order, where appropriate.

We may refuse to release an order where we cannot reasonably verify the collector’s identity or authority.

Orders must be collected within the period stated in the collection notification.

If an order is not collected, we may contact you, cancel the order or return the products to stock. Any refund will be handled in accordance with applicable law and the terms stated at checkout.

25. YOUR RIGHT TO CANCEL AN ONLINE ORDER

Where you are a consumer purchasing online, you will normally have a legal right to change your mind and cancel your order.

For most goods, the cancellation period begins when the contract is formed and ends 14 days after the day on which you, or a person nominated by you, receives the goods.

If an order contains multiple products delivered separately, the cancellation period will normally end 14 days after the day on which the final product is received.

To exercise your right to cancel, you must clearly inform us before the cancellation period expires.

You may contact us at:

Email: info@funhousetoys.co.uk

26. RETURNING GOODS AFTER CANCELLATION

After notifying us that you wish to cancel, you must return the goods without undue delay and no later than 14 days after the day on which you informed us of your decision.

Unless we agree otherwise, goods should be returned to:

Funhouse Toys

22a The Promenade
Portstewart
BT55 7AD

You are responsible for the direct cost of returning unwanted goods unless:

We agreed to pay the return cost.

The goods are faulty, damaged or not as described.

We did not inform you before purchase that you would be responsible for return costs.

Applicable law requires us to pay.

We recommend obtaining proof of postage or using a tracked service. You remain responsible for the goods until they are received by us, except where we arrange collection or applicable law provides otherwise.

27. CONDITION OF RETURNED GOODS

You may inspect goods in the same way that you would reasonably inspect them in a physical shop.

You should not use or handle them beyond what is reasonably necessary to establish their nature, characteristics and operation.

Where handling beyond this level reduces the value of the goods, we may make an appropriate deduction from your refund where legally permitted.

Where possible, goods should be returned with:

Their original packaging.

Instructions and manuals.

Accessories and components.

Free gifts supplied with the product.

Tags, labels and seals that have not reasonably needed to be removed.

A missing or damaged box will not automatically remove your cancellation rights, but it may affect the value of the returned product where the packaging forms part of the product or the loss reduces its resale value.

28. REFUNDS FOLLOWING CANCELLATION

Where you validly cancel an online order, we will refund:

The price paid for the cancelled goods.

The cost of our least expensive standard delivery option, where delivery was charged.

If you selected a more expensive delivery service, we are not required to refund the difference between that service and our standard delivery service.

We may withhold the refund until:

We receive the returned goods, or

You provide evidence that the goods have been sent back,

whichever occurs first.

Refunds will normally be made within 14 days of the relevant date required by law.

We will normally refund you using the original payment method unless you expressly agree otherwise.

29. PRODUCTS THAT MAY NOT BE CANCELLED

The legal right to change your mind may not apply to certain products, including:

Products made to your specifications or clearly personalised.

Sealed products that are not suitable for return for health protection or hygiene reasons once unsealed.

Sealed audio recordings, video recordings or computer software once unsealed.

Products that become inseparably mixed with other items after delivery.

Products that deteriorate or expire rapidly.

Digital content supplied immediately after you expressly consented to supply beginning and acknowledged that your cancellation right would be lost.

An exception will apply only where permitted by law.

This section does not remove your rights where a product is faulty, unsafe, damaged or not as described.

30. PERSONALISED PRODUCTS

You are responsible for checking all names, wording, colours, dates, spellings and other personalisation details before submitting an order.

We may reproduce personalisation exactly as supplied.

Personalised products cannot normally be returned because you changed your mind.

However, you may still have rights where:

We made an error.

The product is faulty.

The product does not match the approved personalisation.

The product is not as described.

We may refuse personalisation containing unlawful, offensive, abusive, discriminatory or infringing content.

31. FAULTY, DAMAGED OR MISDESCRIBED PRODUCTS

Products must be:

Of satisfactory quality.

Fit for their normal purpose.

Fit for any particular purpose made known to us before purchase, where you reasonably relied on our judgement.

As described.

Safe and compliant with applicable legal requirements.

If a product is faulty, damaged, unsafe or not as described, please contact us as soon as reasonably possible.

Depending on the circumstances and the time since delivery, you may be entitled to:

Reject the product and receive a refund.

A repair.

A replacement.

A price reduction.

A final right to reject the product.

Consumers normally have a short-term legal right to reject faulty goods within 30 days of delivery. Different remedies may apply after that period.

Where the product is confirmed to be faulty, damaged or misdescribed, we will cover reasonable return costs or provide an appropriate return method.

We may inspect or test a returned product to confirm the reported issue, but this will not be used to unreasonably delay or deny your legal rights.

Damage caused by misuse, accidental damage, failure to follow instructions, unauthorised modification or normal wear and tear may not be treated as an inherent fault.

Your statutory rights are not affected by any manufacturer’s warranty or guarantee.

32. RETURNS POLICY

Our separate Returns and Refunds Policy explains our practical returns process, including:

How to request a return.

Where to send returned products.

Available return methods.

Return charges.

Expected processing times.

Any voluntary returns period we offer beyond your legal rights.

Our voluntary returns policy does not replace, limit or reduce your statutory rights.

If these Terms or our Returns and Refunds Policy conflict with your mandatory legal rights, your legal rights will apply.

33. REVIEWS AND USER CONTENT

We may allow customers to submit product reviews, photographs, comments, questions or other content.

You must ensure that anything you submit:

Is based on your genuine experience where presented as a review.

Is accurate and not misleading.

Does not contain unlawful, defamatory, threatening or abusive material.

Does not infringe another person’s copyright, trademark, privacy or other rights.

Does not contain personal information about another person without permission.

Does not contain malicious code, spam or unauthorised advertising.

Clearly discloses any payment, free product, discount or other incentive connected with the review.

You must not submit, commission or arrange fake or misleading reviews.

We may moderate, reject or remove content where we reasonably believe it breaches these Terms or applicable law. We will not remove a genuine negative review merely because it is critical of us or a product.

You retain ownership of your content. By submitting it, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, adapt and publish it for operating and promoting our business and products.

This licence ends when the content is deleted from our systems, except where it has already been used in printed material, shared lawfully with others or must be retained for legal reasons.

38. OUR RESPONSIBILITY FOR LOSS OR DAMAGE

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

Loss is foreseeable where it was obvious that it would happen or where both you and we knew it might happen when the contract was formed.

We do not exclude or limit liability for:

Death or personal injury caused by our negligence.

Fraud or fraudulent misrepresentation.

Breach of your statutory rights concerning products.

43. TRANSFER OF RIGHTS

We may transfer our rights and obligations under these Terms to another organisation, for example as part of a sale, restructuring or transfer of our business.

We will ensure that any transfer does not reduce your rights under an existing order.

You may transfer your rights under these Terms only where we agree in writing or where the law permits.

44. THIRD-PARTY RIGHTS

A person who is not a party to the contract between you and us does not have a right to enforce these Terms, except where applicable law expressly provides otherwise.
